Product Liability/Defective Products

If you are injured while using a product, and the product was somehow defective, the manufacturer of the product, as well as the retail distributor or any sales companies in the chain of distribution, can be liable to you for your damages sustained by your injury. The defect may take one of several forms: the product failed (a wring on a ladder collapsed); the product had a flaw or manufacturing defect; the product did not perform correctly or as advertised; the product was designed defectively (failure to install a safety or failsafe device to prevent injury); or appropriate warnings or advisories were not made.

It is not a defense that the manufacturer was not negligent. Once a defect in a product has been established, which caused injury, the manufacturer or distributor is strictly liable, regardless of how careful it may have been in designing or manufacturing the product.

The injured user must not have been guilty of contributory negligence, or have been using the product in a manner not intended; however, the manufacturer can still be liable for failure to issue an adequate warning if the product was being used in a reasonably foreseeable way.

Further, the law imposes an implied warranty that every product is reasonably fit for the purposes for which it is intended.
