Food Poisoning/Foreign SubstanceIf you become ill or suffer injuries as a result of food or drink containing a foreign substance, improper substance, or poison in the form of bacteria or contamination, the seller of such food or drink is strictly liable to you for the damages incurred, including pain and suffering. You do not have to prove negligence, and careful practices or habits are not a defense, providing you can prove that what you purchased and consumed injured you or made you sick. A foreign or improper substance is rather obvious. However, proving food poisoning or contamination is more difficult, necessitating medical confirmation through testing or expert medical opinion, or possibly testing of the product consumed, to confirm the source and cause of your illness.
