Most people are aware that in order to recover from injuries received in a car accident, you must demonstrate that the cause of or the fault of the accident was the person against whom you are making a claim. In other words, more probably than not probably, that person was guilty of negligence, or at least that person was more than 50% at fault in causing the accident. Negligence is the failure to do, or not do, something which a reasonably careful and prudent person would do or not do under the circumstances. However, if you are injured while riding in a bus, taxi, train, or any other mode of mass transit for hire, such carriers, known as common carriers, are held to a much higher degree or standard of care than simple ordinary negligence. Common carriers owe their passengers the highest degree of care in transporting its valuable cargoes (people) and, while not strictly liable for any accidents which may happen, are held to a much higher standard than ordinary operators of motor vehicles.
